Retaliation can occur in numerous forms and may often be hard to identify. For example, an employee may report discrimination or sexual harassment and then begin to notice that the employer is treating them differently. Sometimes employers directly retaliate against employees through terminations or demotions. At other times, employers may retaliate in a more indirect way such as assigning a less desirable shift or passing up the employee for future promotions.
Employers may not retaliate against an employee who oppose unlawful discrimination. Additionally, government employers cannot retaliate against an employee for exercising free speech.
