How long is Maternity leave? The FMLA allows certain employees the ability to take twelve weeks of unpaid maternity or paternity leave. Maternity leave or Paternity leave does not have to be for the birth of a biological child, an employee can take Maternity or Paternity leave for the adoption of a new child to the home.  In addition to the twelve weeks provided by the FMLA, some states may offer additional leave for maternity leave or paternity leave.
