Religious freedom is a founding principle of the United States. Federal and state laws prohibit employment discrimination because of religion. Religious discrimination can take many forms. An employer may not base employment decisions, such as hiring, firing, layoff, transfer, training, compensation, or promotion, on religion. An employer may not treat some employees more or less favorably because of religion.

Religious discrimination law imposes a duty to accommodate sincere religious beliefs. Such accommodations can be:

  • Flexible scheduling,
  • Voluntary substitutions or swaps,
  • Job reassignments and lateral transfers,
  • Modifying workplace practices, policies and/or procedures,
  • Any adjustment to the work environment that will allow the employee to practice his religion.

Religious discrimination law imposes a duty to allow for religious expression. At the same time an employer must protect employees from religious harassment.

An employer may not retaliate against an employee for opposing religious discrimination.
