The USERRA Protects Against Employee Who Take Military LeaveThe Uniformed Services Employment and Reemployment Rights Act ("USERRS") protects employees that are on military leave.  For example, an employee who is a member of the National Guard or Reserves is often required to report to duty.

How long can an employee take military leave?Normally, an employee who takes military leave has the ability to regain employment if the cumulative amount of military leave time is five years or less.  However, there are numerous exceptions, including where the initial enlistment lasted in excess of five years.

What if an employee is injured while taking military leave? An employee who is injured while taking military leave may have additional rights.  For example, the Americans with Disabilities Act ("ADA") requires employers to make reasonable accommodations for employees with disabilities.  This reasonable accommodation can be in the form of allowing additional time off of work or other accommodation to the job.  Furthermore, employees recovering from injuries obtained while on active duty or training may have the right to take an additional two years from the date service was completed to be reinstated.

What duties does an employee have once his or her military leave ends?If the military service was for less than 31 days, the service member must return at the beginning of the next regularly scheduled work period on the first full day after release from service (taking into account travel time plus an eight-hour rest period).
If the military service leave was more than 30 days but less than 181 days, the service member must submit an application for reemployment within 14 days of release from service.
For service of more than 180 days, the service member must submit an application for reemployment within 90 days of release from service.

I would recommend the Law Office of Rob WIley, P.C. to anybody needing assistance with employment rights. They did an incredible job of handling my case professionally and in a very resonable time frame. In my initial consultation with Rob Wiley I was given a very straight forward analysis of my claims after which Fadi Yousef was the attorney assigned to my case. Working with Fadi was the best. He showed care and a true concern for the direction and result of my lawsuit. Fadi was always available and was in constant communication with me throughout. I thank Fadi Yousef, Rob Wiley and his team for doing a phenomenal job, they were an absolute pleasure to work with. R.G.

Rasha, Eric and Rob did it again a Second time around! I'll admit, they are truly the BEST employment lawyers out here in the Metroplex! Not only they won a case against my previous employer, they also won my unemployment insurance (UI) case as well! It is such a relief and a huge burden off my shoulders about not worrying how I'm going to pay my bills now and provide food for my family. I can't say enough how awesome they are and how far they go to make sure you are taken well care of. Thank you so much Rasha, Eric and Rob for all that you did for me! J.T.
