Generally, federal employees have more protection against discrimination in the workplace than private employees. For example, in addition to prohibitions on discrimination based on race, color, religion, sex, national origin, disability, or age, federal employees are also protected against discrimination based on sexual orientation, marital status, and political affiliation. Also, many federal workers may be protected from discrimination based on First Amendment rights of free speech.
Most federal employees have a very short deadline to bring a claim for discrimination. For example, a federal employee must contact an EEO counselor at their agency within 45 days of a discriminatory action.
Unlike most private employees, employees of state agencies and public universities and school districts often have the right to file grievance. An employee of the federal government often has the right to file a claim with the MSPB. The MSPB is a federal agency that hears grievances filed by employees of the federal government.
